CPE advertising and EduTrust claims

The Private Education Act 2009 sets the rules for advertising by private education institutions. Since 1 July 2026 it is administered by the Skills and Workforce Development Agency, which may delegate its powers to the Committee for Private Education (CPE).

  • No false or misleading ads. Section 19 bars ads about an institution that are false or misleading in a material particular. An ad is presumed misleading if it falsely describes the institution or gives false or misleading information about it or its courses.
  • Only permitted courses. Under section 16, advertising a course the Agency has not permitted is an offence.
  • Corrections. Under section 20, the Agency can direct an advertiser to withdraw or change an ad, or publish a corrective one.
  • EduTrust. EduTrust is the Agency's voluntary certification scheme under section 22. Claiming a certification the institution does not hold would be false information about it.
